PREFACE

( ... ) The year 1999 will be further remembered among international air law circles in particular for the Diplomatic Conference convened by ICAO, which culminated in the adoption of a new Montreal Convention on May 28th, 1999. It is hoped that this instrument will soon prove itself a worthy successor and replacement for the venerated yet flawed Warsaw System, while the unusual process of preparing the draft text within ICAO, and the overall dynamics of this Diplomatic Conference, will undoubtedly merit more detailed studies. For the moment, however, we are pleased in this regard to publish herein a number of scholarly pieces by commentators and participants on the new convention. Evidently, the air transport industry - and not ICAO member States themselves - was the initiator and catalyst for this modernization of private international air law. Indeed, States had little choice but to accept the benchmarks being set by industry.

UNIDROIT, ICAO, and TATA have progressed further in their fine - tuning of the Draft Convention on International Interests in Mobile Equipment. Extended deliberations are scheduled for the year 2000. ( ... )
